Light at the end of the WOTUS regulatory tunnel

The general counsel of the National Cattlemen’s Beef Association says for the first time in a long time there is light at the end of the regulatory tunnel for Waters of the United States governments.

Mary – Thomas Hart tells Brownfield that the definition of WOTUS has changed in the last year.

“WOTUS consists exclusively of traditional navigable waters and relatively permanent waters with a continuous surface connection to these traditional navigable waters. This means that many of the issues we have been fighting for over the last 30 to 50 years are no longer subject to federal jurisdiction.”

He says NCBA is pleased with how the EPA responded to the U.S. Supreme Court’s 2023 WOTUS ruling.

“With this, we are about 85% on target. NCBA and a group of national agricultural organizations are still engaged in legal proceedings to tie up some loose ends.”
